**Terms and Conditions for Online Purchase of Aquarium Goods**

These terms and conditions ("Terms", "Agreement") are an agreement between Sai Aquarium ("us", "we", or "our") and you ("User", "you", "your", "customer") governing your purchase of aquarium goods through our website (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

**1. Orders**

1.1. By placing an order through our website, you warrant that you are at least 18 years old and legally capable of entering into binding contracts.

1.2. All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason at any time.

1.3. Once an order is placed, you will receive an email acknowledgment confirming the details of your order. This email is not an acceptance of your order; it is a confirmation that we have received it.

**2. Pricing and Payment**

2.1. All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise stated.

2.2. Payment can be made using the payment methods specified on our website. Payment must be received in full before the order is processed and dispatched.

2.3. We reserve the right to change prices at any time without prior notice. However, such changes will not affect orders that have already been accepted.

**3. Shipping and Delivery**

3.1. We aim to dispatch orders within same day of receiving payment.

However, delivery times may vary depending on your location and the availability of the products.

3.2. Delivery will be made to the address specified in your order. It is your responsibility to ensure that someone is available to accept delivery at the specified address.

3.3. We will not be liable for any delay or failure to deliver your order due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, or transportation disruptions.

**4. Returns and Refunds,Cancellation**

4.1. We accept returns and offer refunds or exchanges based on our CANCELLATION-RETURN-REFUND POLICY. Please contact us immediately if you receive a damaged or faulty item.

4.2. To be eligible for a return, the item must be unused and in the same condition that you received it. It must also be in the original packaging.

4.3. Refunds will be issued to the original payment method used for the purchase. Please allow 7 days for the refund to be processed.

**5. Limitation of Liability**

5.1. To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

(a) your use or inability to use the Service;
(b) any conduct or content of any third party on the Service; or
(c) unauthorized access, use, or alteration of your transmissions or content.

**6. Governing Law**

6.1. These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Bangalore.

**7. Changes to Terms**

7.1. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 1 day notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

**8.Warranty on products Offered**

8.1. Generally all aquatic products comes without warranty unless specified or provided by the manufacturer directly, you may visit the manufacturer’s website, contact us in case you need more information or details for a specific product.

**9. Pricing and Payments**

9.1** – GST credit not available for certain products + additional shipping charges may be applicable for certain products due to shipping from seperate drop shipping location or due to low cart amout. Additional charges if applicable will be displayed during checkout.

Payment once made can not be cancelled or returned unless the non availability of items after placing the order where we will refund the full amount. If you refuse to accept your shipment without our confirmation and initiated return then both way courier charges will be deducted in the order amount and balance will be refunded to your account after receipt of return item in good condition. kindly note that reverse / return courier charges will be 2.5 times of forward courier charge.

9.2. EMI / PayLater / EasyPay : Additional charges may be applicable by card vendor based on your payment mode selection during checkout which includes EMI / PayLater. We are NO WAY connected with additional charges for your transactions for EMI based option. Please check respective banks for applicable charges for card mode payment for EMI / PayLater before choosing card based EMI

**10.Products Images & Details**

10.1. All product names, images, logos & brands are property of their respective owners, and are in no way associated or affiliated with Sai Aquarium. Use of these does not imply any co-operation or endorsement. We respect the intellectual property of others. In case you feel that your work has been copied in a way that constitutes copyright infringement you can write to us at saiaquariumonline@gmail.com.

Images mentioned/specified with each product is for reference purpose and it may contain actual images or refenece images of the product. Images listed in the site is loaded at the time of publishing the product online , actual image/content may differ.

Please check with us before placing order for product compatibility and/or confirmation. NO Exchange / Return applicable for wrongly selected product or for incompatible

Imported products/brands does not have date of import or expiry date of the product which is not mentioned in imported branded items. Further, Sai Aquarium shall not be responsible for ensuring that the content made available are not misleading and describe the actual condition of the Products and Services. Also, You acknowledge and understand that the Company provides no warranty or representation with respect to the authenticity or accuracy of the information provided on the Website and You must do Your own check. The ranking of goods and services as provided on the Platform are determined after collection of rating and feedback from the User, and Sai Aquarium shall not be in any manner held responsible for accuracy of the same. If Retailer or Users find any wrong information on the Website in relation to such fish healthcare products, fertilizers, plant growth booster and water care products, Sai Aquarium shall not be, in any event, held responsible or liable for any damages arising out of such content by third parties.
